• 1 Basic Provisions

1. The following business terms apply to all contracts concluded with us as a supplier via the www.luchinovodka.com website. Unless otherwise agreed upon, the inclusion of your own terms and conditions is excluded.
2. A ‘consumer’ refers to any natural person who enters into a legal transaction primarily for personal use, not attributable to their commercial or professional activities. A ‘business entity’ refers to any natural or legal person or legally recognized partnership that enters into a legal transaction as part of their independent professional or commercial activity.

2. Conclusion of the Contract

3. The listing of goods on our website is not a legally binding offer but rather an invitation to order. If the customer places an order, it constitutes a legally binding offer to purchase.
4. Once an order is placed, the following steps apply:
   • Selection of desired goods.
   • Adding items to the shopping cart.
   • Entering or confirming personal details and payment information.
   • Finalizing the order by pressing the “Order at Cost” button.
5. Before submitting an order, customers can review and correct details at any stage. Once the order is placed, we will confirm receipt via email. However, this confirmation does not constitute order acceptance. Acceptance occurs either through an official acceptance email, shipment of goods, or a separate confirmation.
6. We store the contract text and provide a copy of the order details along with our terms and conditions via email. Customers can access past orders through their account on our website.

3. Intellectual Property & Custom Products

1. Luchino International B.V. remains the exclusive intellectual owner of all products, including custom-designed products. 2. Customers submitting custom designs or modifications warrant that their materials do not infringe upon third-party copyrights, trademarks, or other intellectual property rights. Luchino International B.V. assumes no liability for intellectual property violations caused by customer-submitted content.
3. Any intellectual property rights transferred to customers remain subject to full payment and are for limited use only as specified in the purchase agreement.

4. Right of Retention & Reservation of Proprietary Rights

1. Customers can only exercise a right of retention if their claim arises from the same contractual relationship.
2. All goods remain the property of Luchino International B.V. until full payment has been received.

5. Liability

1. Luchino International B.V. assumes unlimited liability for damages resulting from death, personal injury, or health-related issues caused by our negligence.
2. Our liability extends to cases of intentional misconduct or gross negligence. However, for minor negligence, our liability is limited to foreseeable damages that are typical for the contract.
3. We accept no liability for temporary website downtime, data transmission errors, or system failures.
4. Luchino International B.V. is not liable for damages caused by excessive alcohol consumption, including material damage, injuries, or fatalities.

6. Governing Law & Jurisdiction

1. This contract is governed exclusively by Dutch law.
2. The place of fulfillment and legal jurisdiction for all disputes shall be Amsterdam, Netherlands, unless otherwise required by mandatory consumer protection laws.
3. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

7. Protection of Minors

1. We only enter into sales contracts with customers who meet the legally required minimum age for purchasing alcohol.
2. By placing an order, customers confirm that they meet the minimum legal drinking age and that their information is accurate.
3. Our logistics partners are authorized to verify the recipient’s age upon delivery. If age verification fails, the order will be canceled.

8. Returns & Cancellations

1. Customers have the right to cancel an order within 14 days of receiving the goods, without providing a reason.
2. To initiate a return, customers must notify Luchino International B.V. in writing (email or post) within the cancellation period.
3. Refund Policy:
   • We will reimburse all payments within 14 days of receiving returned goods.
   • Customers bear the cost of return shipping, except in cases of defective or incorrect products.
   • If the returned goods have been damaged due to misuse, Luchino International B.V. reserves the right to deduct costs from the refund.
